with your consent, send you occasional updates or promotional information about our services (you can opt out at any time).
4. Legal Bases for Processing
Under the GDPR, we rely on the following legal bases when processing your personal data:
Contract — processing needed to prepare a quotation you have requested or to perform a contract for services with you.
Legal obligation — processing needed to meet our obligations under Irish tax, accounting and other laws.
Legitimate interests — processing needed to run our business efficiently, keep records of works carried out, and protect ourselves in the event of a dispute, where these interests are not overridden by your rights.
Consent — for direct marketing and for any non-essential cookies. You may withdraw consent at any time by contacting us.
5. Who We Share Your Information With
We do not sell, rent or trade your personal information. We only share it where necessary with:
subcontractors, suppliers and plant/material providers, to the limited extent needed to carry out your project (for example, a delivery address);

IT, website hosting and email service providers who process data on our behalf under appropriate safeguards;
our insurers and legal advisers, where required in connection with a claim; and

Wykes Contracts LTD — wykescontracts.com — Last updated: 21 August 2026
1. Introduction
These Terms and Conditions ("Terms") apply to all quotations given and all landscaping, garden construction, garden design, driveway, patio and garden maintenance services ("Services") supplied by Wykes Contracts LTD ("we", "us", "our"), of Coosan Point Road, Coosan, Athlone, Co. Westmeath, N37 X2T3, Ireland, to any customer ("you", "your"). They also govern your use of our website, https://wykescontracts.com.
By accepting a quotation, paying a deposit, or instructing us to begin work, you agree to these Terms. Nothing in these Terms affects your statutory rights as a consumer under Irish and EU consumer protection law, including the Consumer Rights Act 2022.
2. Quotations and Estimates
All quotations are free of charge and are valid for 30 days from the date of issue, unless stated otherwise.
Quotations are prepared based on the information available at the time, usually following a site visit. If a quotation is prepared without a site visit, it is an estimate only and may be revised once the site has been inspected.
A quotation covers only the works, materials and quantities described in it. Any additional works will be treated as a variation under Section 8.
Unless stated otherwise, quotations include VAT at the applicable rate. We are a VAT-registered business.
We reserve the right to correct genuine errors or omissions in any quotation before a contract is formed.
3. Formation of Contract
A binding contract is formed when you accept our quotation (in writing, by email, by text, or by paying the deposit requested) and we confirm acceptance of the work. The contract consists of the accepted quotation, these Terms, and any written variations agreed between us. If there is any conflict, the accepted quotation takes priority.
4. Deposits and Payment
For construction projects (gardens, driveways, patios and similar works), we may require a deposit before work is scheduled, with the amount stated in your quotation. Deposits are dealt with in accordance with our Refund and Cancellation Policy.
For larger projects, we may agree staged payments linked to progress. Stage amounts and timing will be set out in your quotation.
The balance is payable on completion of the works, or as otherwise set out in your quotation, upon receipt of our invoice.
Invoices are payable within 7 days of the invoice date unless otherwise agreed in writing.
If an invoice remains unpaid after its due date, we may suspend further work, charge interest on the overdue amount at a reasonable rate, and recover reasonable costs of collecting the debt.
Payment may be made by bank transfer or any other method we agree with you. We do not accept responsibility for cash payments made without a written receipt.
5. Scheduling, Weather and Delays
Start dates and completion times are given in good faith and are estimates only. Landscaping is weather-dependent work, and dates may need to change due to weather, ground conditions, supplier delays or circumstances beyond our reasonable control.
We will keep you informed of any significant changes to the schedule and agree new dates with you as early as possible.
We will not be liable for losses caused by delays outside our reasonable control, but we will always take reasonable steps to minimise disruption.
6. Your Obligations
To allow us to carry out the Services safely and efficiently, you agree to:
provide reasonable access to the site, including access for machinery and deliveries where required;
provide access to water and electricity where reasonably needed for the works;
inform us before work begins of anything unusual below the surface that you are aware of, such as pipes, cables, septic tanks, drainage or wells;
obtain any planning permission, consents or permissions from neighbours or management companies that may be required (we can advise, but responsibility rests with the property owner);
keep children and pets away from the work area while works are in progress; and
remove or protect valuables, ornaments and fragile items near the work area.
If we cannot start or continue work because access or site conditions promised by you are not met, we may charge reasonable costs for lost time and rescheduling.
7. Underground Services and Unforeseen Conditions
We take reasonable care to locate underground services before excavation. However, if plans or information are unavailable or inaccurate, we are not liable for damage to unmarked or incorrectly marked pipes, cables or other services that could not reasonably have been identified. If unforeseen ground conditions (such as rock, unstable ground, buried structures or contamination) are discovered, we will stop, discuss the situation with you, and agree any necessary variation before proceeding.
8. Variations and Additional Work
Any changes to the agreed works, whether requested by you or made necessary by site conditions, must be agreed before the additional work is carried out.
We will confirm the price and any effect on the schedule for a variation in writing (email or text is sufficient) wherever practicable.
Variations may affect the completion date, and additional works will be invoiced with, or separately from, the main works as agreed.
9. Materials, Plants and Natural Products
Natural materials such as stone, timber, paving and gravel vary in colour, grain and texture. Samples and photographs are indicative only, and reasonable variation between batches is not a defect.
Plants, trees and turf are living products. We select healthy stock and plant it with good practice, but we cannot guarantee survival where failure results from weather, drought, waterlogging, pests, disease, animal damage or lack of aftercare once the works are complete.
We will provide aftercare guidance on request. Following this guidance, particularly watering of new planting and turf, is your responsibility.
All materials remain our property until paid for in full, without affecting your statutory rights.
10. Workmanship Guarantee
We stand over the quality of our work. In addition to your statutory rights, we will remedy defects in our workmanship on construction works (such as patios, driveways and garden construction) that are notified to us within 12 months of completion, free of charge, provided the defect is not caused by misuse, alteration by others, ground movement outside our control, or ordinary wear and tear. This guarantee is in addition to, and does not limit, your rights under the Consumer Rights Act 2022.
11. Cancellation and Refunds
Cancellations, cooling-off rights and refunds are dealt with in our Refund and Cancellation Policy, which forms part of these Terms and is available on our website or on request.
12. Insurance and Liability
We are a fully insured business and carry public liability insurance. Details are available on request.
We will carry out the Services with reasonable skill and care, using suitable materials, as required by law.
We are liable for damage to your property caused by our negligence. We are not liable for pre-existing defects, or for damage caused by circumstances outside our reasonable control.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded under Irish law.
Subject to the above, our total liability arising out of any project is limited to the price paid or payable for that project, and we are not liable for indirect or consequential losses.
13. Health and Safety
We operate in line with applicable health and safety requirements. The work area is a construction site while works are in progress; you agree to follow our reasonable safety requests, including keeping people and pets clear of machinery, excavations and materials.
14. Complaints
If you are unhappy with any aspect of our work, please tell us as soon as possible by phone (085 157 8500) or email ([email protected]). We take complaints seriously and will investigate and respond promptly, and where something is not right, we will put it right. If a dispute cannot be resolved between us, you may be able to refer the matter to the Small Claims procedure of the District Court (for claims up to the applicable limit) or seek advice from the Competition and Consumer Protection Commission (CCPC), www.ccpc.ie.
15. Website Use
The content of our website is provided for general information only and does not constitute a binding offer. Photographs of previous projects are examples of our work.
All content on the website, including text, images and logos, belongs to us or our licensors and may not be reused for commercial purposes without permission.
We take reasonable care to keep the website accurate and available but do not guarantee that it will be uninterrupted or error-free.
16. General
If any part of these Terms is found to be invalid or unenforceable, the remainder continues in full force.
A failure by either party to enforce any right under these Terms is not a waiver of that right.
These Terms and any contract between us are governed by the laws of Ireland, and the Irish courts have jurisdiction over any dispute, without affecting your rights as a consumer to bring or defend proceedings in your home jurisdiction.

1. Overview
This Refund and Cancellation Policy applies to all landscaping, garden construction, garden design, driveway, patio and garden maintenance services supplied by Wykes Contracts LTD. Because we provide services rather than sell goods online, this policy deals mainly with deposits, cancellations, rescheduling and remedies where work falls short, rather than product returns.
This policy forms part of our Terms and Conditions. Nothing in it limits your statutory rights under Irish and EU consumer law, including the Consumer Rights Act 2022 and the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013.
2. Your 14-Day Cooling-Off Period
Where you agree a contract with us at your home or otherwise away from our business premises, or entirely by phone, email or through our website, you have a statutory right to cancel within 14 days of the day the contract is made, without giving a reason.
To cancel within the cooling-off period, simply tell us clearly by email or phone (contact details below) before the 14 days expire.
If you cancel within the cooling-off period before any work has started, we will refund all sums paid, including any deposit, in full.
If you ask us in writing to start work during the cooling-off period and then cancel before the work is finished, you must pay for the part of the work already done and materials already supplied, and we will refund the balance.
The cooling-off right no longer applies once the contracted work has been fully completed with your prior agreement.
3. Deposits
Where a deposit is requested, the amount will be stated in your quotation. Deposits secure your place in our schedule and allow us to order materials for your project.
Deposits are refundable in full if you cancel within the 14-day cooling-off period (before work starts), or if we cancel the project for reasons other than your breach of the contract.
Outside the cooling-off period, if you cancel before materials have been ordered and with reasonable notice (see Section 4), we will refund your deposit less any costs we have genuinely and reasonably incurred on your project.
Where special-order or custom materials have already been purchased for your project and cannot be returned or reused, the cost of those materials may be deducted from any refund. We will provide evidence of such costs on request.
4. Cancellation by You (After the Cooling-Off Period)
More than 14 days before the scheduled start date: full refund of sums paid, less any non-recoverable costs already incurred (such as special-order materials).
14 days or less before the scheduled start date: refund of sums paid, less non-recoverable costs incurred and a reasonable charge for scheduling loss where we cannot re-fill the booked slot at short notice.
After work has started: you pay for work done and materials supplied up to the date of cancellation; any balance of payments made above that amount will be refunded.
For ongoing garden maintenance arrangements, you may cancel at any time with at least 7 days' notice before the next scheduled visit. Visits already completed remain chargeable.
5. Cancellation or Rescheduling by Us
Landscaping work depends on weather and ground conditions. If we need to postpone work for weather or safety reasons, we will agree a new date with you as soon as possible. Postponement for weather is not a cancellation and does not of itself entitle either party to end the contract.
If we have to cancel your project for reasons within our control and cannot offer a reasonable alternative date, we will refund all sums paid, including your deposit, in full.
We are not liable for additional compensation for delays or cancellations caused by events outside our reasonable control, although we will always try to minimise any inconvenience.
6. If Something Is Not Right With Our Work
Under the Consumer Rights Act 2022, services must be carried out with reasonable skill and care, and any materials used must be of the quality agreed. If our work falls short of this standard:
tell us as soon as reasonably possible after you notice the problem;
we will first put the work right at no cost to you, within a reasonable time and without significant inconvenience;
if we cannot remedy the problem, or fail to do so within a reasonable time, you are entitled to an appropriate price reduction or, where the failure is significant, to end the contract and receive a proportionate refund.
This is in addition to our own 12-month workmanship guarantee described in our Terms and Conditions.
7. Plants, Turf and Living Materials
Plants, trees and turf are living products and their survival depends heavily on aftercare and conditions after we leave the site. We will replace planting that fails due to defective stock or poor planting practice on our part where this is reported within a reasonable time. We do not refund or replace planting that fails due to drought, waterlogging, frost, pests, animal damage or lack of watering and aftercare following the guidance we provide.
8. How Refunds Are Paid
Approved refunds are made using the same payment method you used to pay us, unless we agree otherwise with you.
Refunds due under the cooling-off rules are made within 14 days of your cancellation.
Other agreed refunds are made within 14 days of the refund being agreed.
We will confirm every refund to you in writing (email or text).
9. How to Cancel or Request a Refund
To cancel a booking or request a refund, contact us with your name, address, project details and the reason for your request:
We aim to acknowledge all cancellation and refund requests within 2 working days.
10. Disputes
If you are unhappy with our response to a refund request, please raise it with us first and we will try to resolve it fairly. You may also seek independent advice from the Competition and Consumer Protection Commission (www.ccpc.ie) or use the Small Claims procedure of the District Court for eligible claims.
